pedestrian or bicycle rider is hit by a motor vehicle, the

Quite often, the fault or blame for the accident lies partly
with the motorist and partly with the injured pedestrian or
bicyclist. The fact that an injured pedestrian or bicyclist
may be partly to blame for the accident does not bar a
recovery under Missouri law – it only reduces the amount of
the recovery. Missouri has a pure comparative fault law
which means that the total damages suffered for the injury
or death are reduced by the percentage of fault to be
applied to the pedestrian or bicycle operator. For example,
if the driver of a motor vehicle was exceeding the speed
limit and found to be 60% at fault, with a pedestrian or
bicycle operator 40% at fault, the monetary recovery would
be 60% of the total damages sustained.
