Railroad Crossing Accidents
In 2000, the United States
railroad system encompassed 220,000 miles of track, 20,000
freight locomotives, 8,800 passenger locomotives (coaches),
1,300,000 freight cars, and 265,000 employees according to
the Federal Railroad Administration. Railroad crossing
accidents, which unfortunately occur far too often in
Missouri, Arkansas and all over the country, often result in
catastrophic injuries including amputation, fractures, brain
damage, paralysis, and, in extreme cases, death.
According to the Federal
Railroad Administration, railroad grade crossing accidents
are the greatest cause of fatalities and injuries in the
railroad industry. In 2000, there were a total of 3,502
railroad accidents at public crossings, resulting in 425
fatalities and 1,219 injuries. It is the railroad’s
responsibility to ensure there are appropriate signs and
signals at railroad crossings to avoid serious accidents and
injuries. It is also the railroad’s responsibility to sound
a warning before and as they go through each crossing. If
the railroad fails to provide adequate warnings, they may be
liable for personal injury or death that occurs as a result
of their negligence.
At the law firm of Henry, Williams and Engelbrecht, we
have extensive experience handling serious injury and death
cases for collisions which have occurred at railroad grade
crossings.
