Who Can Bring a Wrongful Death Suit?

 

The statutes of most states set forth who can bring an action for wrongful death.  In Missouri, suits may be brought by the spouse or children, the surviving descendants of any deceased children, natural or adopted, legitimate or illegitimate, or by the father or mother of the deceased family member.  If there is no spouse, children, living descendants of any deceased children, father or mother of the deceased, the action for wrongful death may then be brought by a brother or sister of the deceased. 

 

 

Where Can a Wrongful Death Action Be Brought?

 

Most states have statutes referred to as venue laws which determine where an action for wrongful death may be filed.  In Missouri, if the decedent was injured in the State of Missouri, the suit must be brought in the county where the decedent was first injured by the wrongful act or negligent conduct alleged in the action.  If the deceased family member was first injured outside the state of Missouri, different venue rules apply depending on whether the defendant is an individual or corporation.

 

 

When Must the Action Be Brought?

 

All states have laws which govern the time limits in which a wrongful death suit must be brought.  These laws are called statutes of limitations.  Although the statutes of limitations for the bringing of a wrongful death action vary from state to state, the laws of Missouri provide that an action for wrongful death must be brought within three years.
